By accessing or using the Ma7alak application or website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these terms, you must discontinue using our services immediately.

2 حقوق الملكية الفكرية وحظر الهندسة العكسيةIntellectual Property & Anti-Reverse-Engineering

جميع الأكواد المصدرية، التصاميم الهندسية، واجهات المستخدم، قواعد البيانات، والخوارزميات البرمجية محمية بموجب قوانين حماية الملكية الفكرية وحقوق المؤلف الدولية وقانون حماية البرمجيات اللبناني والدولي.

All source code, software architecture, UI assets, database schemas, and proprietary algorithms are strictly protected under international intellectual property treaties, copyright laws, and trade secret protections.

يحظر تماماً تحت طائلة الملاحقة القضائية المدنية والجزائية:

The following actions are strictly prohibited and subject to legal prosecution:

• محاولة فك تشفير التطبيق، أو تفكيك الكود البرمجي (Decompiling)، أو الهندسة العكسية (Reverse Engineering) لأي جزء من المنصة.
• Decompiling, disassembling, reverse engineering, or extracting source code from any part of the mobile apps or backend.
• استخدام برامج الجمع التلقائي (Web Scraping / Crawling) لنسخ قوائم المتاجر أو الأسعار أو بيانات المستخدمين.
• Using automated scrapers, bots, or crawlers to harvest store menus, pricing, or proprietary data.
• استنساخ المنصة أو بيع أو إعادة ترخيص أي جزء منها لأي طرف ثالث دون موافقة كتابية صريحة من المالك التقني CE. Firas AlDaher.
• Cloning, reselling, sublicensing, or distributing any part of the platform without explicit written authorization from CE. Firas AlDaher.

3 العلامات التجارية وحقوق الأطراف الثالثة (إشعار DMCA)Third-Party Trademarks & DMCA Notice

إذا كنت مالكاً لعلامة تجارية أو ممثلاً قانونياً وترى أن هناك محتوى يحتاج إلى تعديل أو إزالة، يرجى التواصل فوراً مع وكيل الملكية الفكرية المعتمد لدينا عبر البريد الإلكتروني: [email protected]. نلتزم بفحص ومعالجة أي طلب محق خلال 24 إلى 48 ساعة بروح من التعاون التام.

4 المنافسة العادلة وحظر التخريب والتقارير الكيديةFair Competition & Anti-Sabotage Policy

تخضع المنصة لأنظمة حماية متقدمة تكشف وتسجل عناوين IP وتفاصيل الأجهزة لأي محاولات تخريبية أو بلاغات كيدية:

The platform employs proactive security logging to identify fraudulent attacks and bad-faith actions:

• يُمنع منعاً باتاً إنشاء حسابات وهمية لإرسال طلبات كاذبة بهدف الإضرار بالمتاجر أو بالسائقين.
• Creating fake accounts or placing fraudulent orders to inflict losses on merchants or drivers is strictly prohibited.
• أي محاولات للإبلاغ الكيدي على متاجر التطبيقات (Google Play أو Apple App Store) بدعاوى باطلة يتم توثيقها ورفعها للجهات القضائية ومتاجر التطبيقات لمحاسبة الجهات المنفذة للمنافسة غير المشروعة.
• Malicious bad-faith reports submitted to app stores will be met with formal counter-notifications, logs, and legal action against perpetrators of anti-competitive practices.

5 الطلبات وطرق الدفع والرسومOrders, Payments & Fees

• طرق الدفع: يدعم التطبيق الدفع نقداً عند الاستلام (Cash on Delivery) وكذلك الدفع الإلكتروني عبر محفظة Whish Money المعتمدة في لبنان.
• Payment Options: The app supports Cash on Delivery (COD) as well as certified electronic payments through Whish Money.
• حماية العمليات المالية: لا يتم حفظ أي بيانات بطاقات مصرفية أو أرقام سرية للمحافظ على خوادم محلّك، وتتم معالجة الدفع عبر قنوات Whish المشفرة والآمنة.
• Payment Security: Sensitive financial credentials are never stored on Ma7alak servers; transactions are processed through encrypted Whish gateway protocols.
• رسوم التوصيل والخدمة: يتم احتساب رسوم التوصيل بشفافية تامة بناءً على المسافة الجغرافية لموقع التوصيل، كما تتضمن الطلبات رسوم خدمة رمزية قابلة للتعديل لدعم تشغيل وتحديث المنصة.
• Delivery & Service Fees: Delivery fees are dynamically and transparently calculated based on distance. A nominal service fee supports platform maintenance and customer support.
